Privacy Policy

Off the Shot ("Off the Shot," "we," "us," or "our") is currently in a pre-launch waitlist phase, operated by [ENTITY NAME] (a company that has not yet been formally incorporated at the time of this draft). This Privacy Policy describes how we collect, use, and protect information when you visit our waitlist landing page and sign up to be notified about the Off the Shot app.

Off the Shot is a wellness product, not a medical device or healthcare provider, and this landing page does not currently collect any health data directly from you beyond what is described below.

1. Information we collect

2. How we use your information

To notify you about the Off the Shot app launch and related product updates.
To measure and improve our advertising (TikTok, Meta) and understand which messaging resonates.
To analyze aggregate traffic and signup trends on this landing page.
To comply with legal obligations and protect against fraud or abuse.

3. We do not sell your data

We do not sell your personal information. We do not share your email address with third parties for their own independent marketing purposes. We do share limited event-level data with advertising platforms (TikTok, Meta) as described above, strictly to measure and optimize our own ad campaigns — this is a standard "sharing for cross-context behavioral advertising" arrangement under CCPA/CPRA, and you can opt out as described in Section 6.

Washington My Health My Data Act (MHMDA): although this waitlist page does not currently collect consumer health data as defined by the MHMDA, we are voluntarily providing the disclosures below because Off the Shot's eventual product relates to health and wellness, and because some visitors may be located in Washington State.

4. Washington My Health My Data Act disclosures

The Washington My Health My Data Act ("MHMDA") defines "consumer health data" broadly, and gives Washington consumers specific rights over that data. We take the following commitments:

We do not sell consumer health data and will never sell it without your prior, separate, and explicit authorization, as required by the MHMDA.
We do not use geofencing around healthcare facilities to collect data or target ads.
If, in a future version of Off the Shot, we collect data that qualifies as consumer health data (for example, weight logs, meal logs, or craving check-ins once the app itself is available), we will obtain your consent before collecting it and provide a dedicated consumer health data privacy policy describing what we collect, why, who we share it with, and how long we keep it.
Right to confirm and access: you may request confirmation of whether we hold consumer health data about you, and request access to it.
Right to withdraw consent: you may withdraw any consent you previously gave for the collection or sharing of your consumer health data at any time.
Right to deletion: you may request that we delete your consumer health data, and we will delete it from our records and direct any service providers or processors to do the same, subject to limited legal exceptions.
To exercise any of these rights, email offshotapp@gmail.com. We will respond within the timeframe required by applicable law. You will not be charged a fee for a reasonable exercise of these rights, and we will not discriminate against you for exercising them. If we deny a request, you may appeal by replying to our denial email, and we will respond to appeals within 45 days.

5. California (CCPA / CPRA)

If you are a California resident, you have the right to know what personal information we collect, request deletion of your personal information, correct inaccurate information, and opt out of the "sale" or "sharing" of your personal information (including for cross-context behavioral advertising, which covers our use of ad pixels). We do not knowingly sell personal information for money. To exercise any of these rights, email offshotapp@gmail.com with the subject line "California Privacy Request." We will not discriminate against you for exercising these rights.

6. Your choices

Unsubscribe: every email we send will include an unsubscribe link. You may also email us directly to be removed from our list.
Ad opt-outs: you can limit TikTok and Meta's use of your data for ad personalization through their own privacy controls (TikTok Ads Settings, Meta Ad Preferences) or by using browser/device-level tracking controls.
Deletion: email offshotapp@gmail.com with "Delete my data" and the email address you signed up with. We will delete your information from our active systems within 30 days, except where we are required to retain it for legal, security, or fraud-prevention reasons.

7. Data retention

We retain waitlist email addresses and associated signup metadata until the earlier of: (a) app launch plus a reasonable follow-up window, (b) your deletion request, or (c) two years of inactivity, at which point we will delete or anonymize the data. Aggregate, de-identified analytics data may be retained longer for internal reporting purposes.

8. Data security

We use commercially reasonable technical and organizational measures to protect the information we collect. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Children's privacy

Off the Shot is intended for adults 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from someone under 18, we will delete it promptly. If you believe a minor has submitted information to us, please contact us at offshotapp@gmail.com.

10. Third-party links and services

This site may link to third-party services (for example, TikTok, Instagram, or an email service provider). Those services have their own privacy policies, and we encourage you to review them. This policy applies only to data we collect directly.

11. Changes to this policy

We may update this policy as the product evolves, particularly once the Off the Shot app itself launches and begins collecting health-related data. We will post the updated policy here with a new effective date, and for material changes affecting consumer health data, we will seek your renewed consent where required by law.
